Pip appeal was created by ros
Hi
My husband was on DLA after he suffered a stroke in 2011
He had the high rate mobility and daily living award for an indefinite period.

We have just received the PIP letter (after assessment by ATOS)
He has been awarded 11 points for daily living and only 4 points for help with mobility!
So, now only awarded standard rate for daily living needs and NO award for mobility needs!

I intend to appeal, and will use your MANDATORY RECONSIDERATION REQUEST letter.
Do I need to request a copy of his ATOS assessment from DWP before I send the letter?
This is the first time I have written on the site, I hope I'm in the right place...
Thank you

You should certainly ask for a copy of the report and if you receive it in time then it will help you word your MR request, however, it is important that the DWP receive your request within one month of the Decision date, so you should not hold back your request if the report is not received in time.

My husband suffered a stroke. He was on DLA highly rate for care and mobility. After assessment, DLA will cease in Jan 2017.he has been awarded PIP standard rate for Daily living activities and no award for mobility.
I have written and asked for a mandatory reconsideration. I'm awaiting a reply.
I have obtained a copy of ATOS report and written a draft of the discrepancies with the discriptors we believe to be 'best fit'.
We now have a Letter from GP.
Can you offer any more advice?
than you

Hi ros,

I have merged your query with the previous topic relating to your husband's PIP as we ask members to keep everything to do with the same claim in one topic.

Please may I clarify your situation? Have you already submitted the MR request but have not had a decision? And your GP has now provided a report in support?

If this is the case, it is worth sending a copy of the letter to DWP in the hope that it will catch up with your husband's file before the MR is carried out.

Did you expect this letter and warn DWP that you would be sending it later? If so, they should give you a bit of extra time to submit it - but we are aware that they don't always do so!

Please reply to this message with further questions or comments and we will do our best to help. You will find it easily in future if you favourite/bookmark it on your web browser now.
