I am going through all the discrepancies on the Medical,Report and it will take time. Is it best to send this with the Mamdatory Reconsideration Letter or can it wait for the Independemt Tribunal?
Thank you.
Thank you.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Julie,
There are two ways of looking at this -
Some people send in every extra piece of information and evidence possible in the hope of getting the decision revised in their favour at MR. This would take longer but also mean that payments would start reasonably quickly and the claimant is spared the stress of an appeal.
Some people, knowing that MR's don't often change the decision, decide to get it over and done with as soon as possible, sending in little information so that they can move on to appeal sooner.
Which strategy you use is up to you.

There are many discrepancies in the Consultation Report which are incorrect, assumptions made, misreporting, I am going through line by line. is it best to nitpick the Consultation Report before the Tribunal to keep the case more succinct and not innundate them with important corrections to HP remarks? Therefore focussing more so with the succinct conclusion for Tribunal. Hope you understand where I am coming from.

You will only receive an award by showing that you meet the criteria for one, so this should be your priority, I'm not saying you should ignore the report but arguing the content will not in itself result in an award. DM's take the report as is. So unless you can show a fundamental issue with the content it is unlikely that they will ignore the report and even if you do the most likely result is that a new report will be required, which could require a new assessment.
