hello,i am helping my uncle,he was under the care of the mht team for 5 years,severe depression,last year the hospital doctor,decided to refer him back to the care of his gp,because he considered, he was now at low risk,having stabilised the condition,and because he was well supported by his family,and that he willl continue to take medication which was unchanged.he has an esa medical soon and also a dla to pip invitation letter.His care needs have remained the same since he was gived an indifinite dla award 2 years ago.i was wondering how best to approach the pip form and will the fact he is no longer under the hospital weaken his claim to both esa and pip claims.your advice would be appreciated thanks

The first thing to be aware of is that the PIP assessment criteria are very different from those that operate for DLA and that PIP has been deliberately engineered to reduce the disability budget.

I would start by having a good read of our PIP Claim guide, this explains the claim process; the questions that will be asked as part of the initial call and the criteria that your uncle will be assessed against. See

Many claimants have been parked by the NHS so it is not unusual to not have up to date medical evidence, the impact this will have will depend on the conditions and whether they have remained stable and if they have changed, whether this was for the better or the worse.

It would be a good idea for your uncle to approach his GP to see what support they might be prepared to provide.

thanks for your reply,he seen a gp for a support letter when the esa letter arrived she told him that appointments were not for letters and to put the request in writing to the practise,and another doctor would sort it out going back on the medical records,no one knew how to word the letter, so we left it at that. After sending the form back,after reading your guides, his gp called him in to discuss some of the side effects of the medication he is on, sleepyness poor memory and concentration, so i think more information was requested,the doctor asked him was his depression stable he said it was,she said she was going to try and wean him off the anti-depressant, until he explained,now was not the time because of problems going on in his life at the moment, so she said she would leave them be.And send for him when she needs to see him.Should i take him to see the doctor and see if they will support him, or just fill in the pip form following your guides thanks

Their previous comments would suggest that they are not going to provide support but for the sake of a trip to see them I would make an appointment, if nothing else your uncle can spend some time telling his GP about the problems he has with his daily activities on the off chance that the DWP contact hem.
