I receive income related ESA also pip enhanced rate for care I also receive severe disability premium because I live alone and no one claims carers allowance for me my husband left in 2012 -2013 but because of my physical disability and my declining mental health he's suggested moving back in to help me so if this happens I know I will have to cont the DWP to tell them he works 35hour a week just over minimum wage so my question is will loose all of my benefits thanks in advance

Hi Sully,

As you say, you will certainly lose your SDP (unless your husband is also claiming DLA/PIP).

Whether you keep your ESA will depend on your relationship with your husband (you don't need to tell us here!). If you are going to live as husband and wife, his working hours will mean that you are no longer eligible for ESA at all.

24 hour work rule for ESA(IR)

If you are not going to live together as husband and wife, you should keep your ESA as long as you can convince DWP of your relationship.

If you are also in receipt of any other benefits it would be a good idea to get face2face advice about how these would be affected by the change.

Thanks for your reply just another question if I loose the ESA am I correct in thinking if I still receive pip enhanced care would my ex husband be Able to claim attendance allowance for me because that is the reason why we are considering moving back because I'm not coping with my physical and mental health I did look at the link you sent but I'm not in a good place today thanks

Do you mean Carers Allowance? Attendance Allowance is the equivalent of DLA for the over 65's!

Your husband will not be able to claim CA if he is working full time there is an earnings limit for CA of £110 per week.
