ESA/backdated occupational pension clash? was created by blindhelix
After three years of fighting, today I've been informed that I'm being retired on Tier 1 Ill Health! The Unison rep who has supported me through everything is trying to have my LGPS pension backdated to 2015, when I was initially refused. I haven't appealed - they've just changed their decision...

My question is this: I'm in the support group for ESA (contribution based). If my pension is backdated, will I need to repay some of the ESA I've received in the intervening time?

Any thoughts on this would be appreciated.

Hi and Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

I can only speak from my own experience - I had some backpay when my pension was awarded (albeit not as much as you might be expecting) and DWP did not ask me to pay anything back.

When your pension is in payment, the first £85 per week will be disregarded, then you will loose 50p ESA for every extra £1 of pension.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
