can anyone advise please
i had the dreaded esa50 form sent to me 1/12/15 and had to send it back by 1/1/16 which i did.
(I'm already in the support group at this time and I'm my sons carer due to his disability ) i didn't hear a thing from them until 18/8/16 to say i need to attend an assessment on the 14/9/16. i attended this with my dad as my support and i even had a mini breakdown in there (i have bi-polar affective disorder) i remember her telling me to answer her questions or she can't continue with this as i was very anxious and depressed with my illness going mental inside my head. she didn't have any compassion for me at all and was very stern with me. after i left there in a mess i hadn't herd from them for a while. playing on my mind is not a good thing for me. i noticed that my esa had been lowered in dec 2016 when i checked my bank. i called on the 22/12/16 to find out what has happened and was told that i had been moved from support group to work group. since 30/11/16. i had not even had a letter in the post about this which the lady then said its on its way. i rant them on the 22/12/16 once i received the letter dated 11/12/16. and said that i didn't agree with this and would like a mandatory appeal done and if i could have the written decision sent to me which the lady said will be sent to me along with the mandatory appeal. I've still not received this. today i had a letter which i thought was all the paperwork they was sending me. once opened it is another esa50 form that i have to fill out again and send back on the 13/2/17. I've called the number on the letter to find out why am i getting this again and explained this to the lady who says i have to fill this out as I've been put in the work group and they need to assess me. once i explained that I've already been through this process and I'm appealing the decision she says that i still have to fill it out and the letter that I'm waiting on has been processed yesterday and i will receive this within the next few days depending on the 2nd class system. I've spoken to my gp who is seeing my this evening due to my mental health and anxiety levels going through the roof.
can anyone advise me please. thank you for reading this.

Hi natty,

Legislation allows for ESA claims to be reassessed 3 months after the decision was made - although we do not see these very short awards often, usually when the claimant's condition is expected to change in that short period of time.

I suggest you phone DWP again and ask to speak to a supervisor (this will require a call-back). These people usually have a bit more knowledge and might be able to help.

However, until/unless you have it in writing from DWP that you do not have to complete the new ESA50, I'm afraid I have to advise you to do so or risk your claim being closed :(

hi mrs hurtyback

I've just called them and the lady said that the mandatory decision had not been advised so she said i will need to write a statement in and say i need to appeal this decision and to wait till next week when i receive the paperwork then to respond with my appeal and advised me to fill out the esa50 if i need more time to call them. I'm going to see my gp shortly and hopefully get supporting evidence to help me.

If the MR did not find in your favour, you will need to contact the Tribunal Service with your request to appeal. There is a special from (SSC1) for this and you will have to include a copy of the MR decision letter.

The appeal decision will run until the date of the new decision (on the reassessment you are now going through).

Hi there.mim going through exactly the same! Another ruddy ESA50 and more than likely another waste of time WCA.
I didn't realised the 3 month check they have introduced, in particular for people on Income Related esa in WRAG.
I don t have my original copy which is annoying but just proves I'm all over the place with this.
I need to het mine back by 24 January. Have they informed you they will stop paying you up to a specific date. I'm scared if I have to appeal my money will be frozen.

The bottom line is money! No empathy . Fought 2 tribunals. I broke down at both as it really did get to me. They did say that I was creditable. NB I had my PIP stopped last year. Went to Tribunal and got it back for 3 years. (I hope)
Good luck, keep me posted and I will do the same.it's like a huge black cloud hanging over you and your day to day motivation basically grind to a halt.
The moderator' are great on hear and the one thing they will say is FIGHT! As hard it is, please don't give up!
