Do I include these difficulties regarding not being able to walk 50 metres without staggering in the moving around section or does this apply only to people with difficulties walking whilst in pain? F does not have pain whilst walking. Her problem is she cannot walk in a straight line and people bumping into her from behind.

Yes, the Moving Around activity is for physical problems that a claimant has with walking.

Hussajahe wrote: Hi, I have another question if you don't mind answering.
I would like to quote some upper tribunal decisions regarding engaging face to face. Should I print and add the relevant case to my reconsideration letter or just give the case number and quote from it?

I would quote relevant sections and include a link to the actual Decision but be aware the DM's are unlikely to pay attention to Case Law unless they have been informed about it via an internal memo, so don't rely on it as your only argument.

Also, make sure that you fully understand the Decision, they are rarely back and white.

Hi
My daughter cannot walk 50 metres without staggering and losing her balance. She has to stop to steady herself then carries on walking. She can walk more than 200 metres, but has to stop because of feeling unsteady along the way. She walks to the station in the morning to go to work, which is more than 200 metres.

Her problems walking are worse in the evenings as she has had to use a great deal of cognitive energy to maintain equilibrium and stay steady (something that is normally done automatically). She is too exhausted to walk home from the station after work.

I feel that she cannot walk safely or to an acceptable standard for the majority of the days due to her balance disorder.

Do you think I should pursue the moving around activity as she can walk more than 200 metres?
I'm just a bit confused as to whether she meets the criteria or not.

I think that she may struggle to score points for this activity, but if you do not argue her case then she certainly won't so you/she have nothing to lose.

My daughter had her tribunal last Friday. She was awarded 8 points for communication and 4 for engaging socially. She already recieved 2 points for washing after her face to face assessment. Unfortunately she didn't get any points for mobility, which she was on the lower rate for DLA.
Thank you all for your advice and help.
