You write to them c/o the Tribunal venue for your appeal.

Hi Gorden,
Last week I got my Mandentry reconsider results and nothing has changed from the original decision and I also put down that as PIP Gude it clearly states that some one suffering from COPD in my case I m suffering from Severe COPD will not need f2f consultation and Case manager has ignored this question so PIP Assesment guide is just the guide but not taken as the process.I m now going to appeal to the tribunal but just worried will I loose the award I have been awarded which is standard on living n mobility and I was on higher on DLA I indefinatly.i also wrote to my MP and it seems he is not got any update .thanks.

If the panel has issues with your current award then they are required to tell you at the beginning of the hearing so that you can withdraw your appeal.

Forgive me but I'm not aware of anything in the PIP Claim guide that suggests the claimants with COPD should be excused from the need for face to face assessment.

PIP Assesment guide page 31 2,5,10 it clearly states that cases that do not require face to face consultation health condition is severe and assciated with high level of functional impairment Example severe COPD which I suffer from with all the medical evidence provided on 'how the disability affrects you form'.My manditary case manager ingnored my question n no response was given in her decision.
I feel like writing to The Hon.Seceratry of DWP Mr Damien Green that PIP assesers are not implying the guide line wihich is in PIP Assesment guide and I also think Mr.Green is aware of this. and the case managers are giving hard time to disable people who are entitle for their rights and I also remember mr Damien Green made a statement sometime last October 2016 that any one with Cronic illness will not have to be assessed .

So this is the problem.

This is guidance and not required and it presumes that the Assessment Provider agrees that your COPD is severe.

However, even if they did, they need to be able to make a recommendation to the DWP on what activities you should score points for, if they do not feel able to do so based on your diagnosis and the information in and with your PIP2, then an assessment can be required.

Lastly, assessment Decisions lie with the AP not the DWP so I am not surprised that the Case Manager did not comment.

If you want to make a complaint then do so to the AP.
