Hi Martha,

Yes, it does sound as if you have not been awarded PIP. However, it is the DWP Decision Maker who will have the final say. We don't often see them go against the HealthCare Practitioner's recommendation but it does happen sometimes.

You have 2 options at this stage -

You could wait until you have the decision letter and then ask for a Mandatory Reconsideration (or re-apply if you do not get an award).

You could contact the assessment provider (ATOS or Capita depending on your postcode) and complain about the assessment - and run the risk that you will be required to have a further assessment, which will possibly not be any different.

Thank you, the decsion letter came today and indeed 0 points all round. The DM basically copied the words written by the HP. This makes both documents to show that the assessment does not correctly assessmy severe health conditions either together and or separately nor does it reflect that my conditions remain unpredictable, impact on all my daily living due to unpredicabilty, severe pain cause extreme anxiety and place me at risk of harm both inside and outside unless I am supported by my husband. I have had my driving license taken away by the dvla due to my condition being unstable and unpredictable but the dwp seem to think that as this was 4 years ago this no longer counts. My migrainous vertigo and meneieres disease prevent me from having a license. My local authority issued me with a bus travel pass due to this but now I guess I will loose this too. My employer for whom I worked for for 30 years finished me on 31/12/2016 due to my continued sickness and even though I told the dwp this and the fact that I had not actually been able to work since 2015 and have been advised by gp not to work as this is causing increased detriment to my health, i am at a total loss to resolve my application for pip. I am distressed to put it bluntly.

Hi Martha,

I understand your distress :(

You mention that you have been sacked from your job as you are unable to work - but DWP are not interested in this fact when assessing for PIP. The PIP criteria are very specific, you have to show how and why you meet them, why aids or assistance do/do not help you and also that your problems are with you for the majority of days.

You can take this particular claim further by asking for a Mandatory Reconsideration - these are only occasional successful but they are something that must be done before going on to appeal.

You could also opt to forget about this claim and make a new one. I would suggest this course of action in particular if you feel that, having read our PIP guide, you maybe didn't explain your problems as well as you might have.

In fact, you could ask for MR and reapply but should be aware that the new decision would supersede the appeal decision.

You have one month from the date of the decision letter in which to get a MR request in to DWP, so you do not have to do anything straight away. The MR process is explained in the PIP guide, so I suggest that reading the guide should be your first step, then you can consider your options.
