IS IT TOO LATE ? was created by Marilyn Hodgkinson
I have secondary progressive MS. I was awarded indefinite DLA in 2001 following a positive diagnosis in 1982. My circumstances changed in 2001 in that I was left alone to cope and therefore I felt I needed extra help.
In March 2016 I was informed that DLA was ending and I was invited to apply for PIP.
I duly filled in the necessary forms - very fully with supporting evidence of my condition.
I attended (with difficulty) the assessment by ATOS.
In June 2016 I was informed that I had not been accepted for PIP and that I could ask for a reconsideration. I applied for a reconsideration - supplying more evidence of my condition.
I was informed in September 2016 that I would be awarded the standard rate PIP for mobility but nothing for the care component. I could appeal against the decision if I chose to.
At that time I didn't feel able to continue with the fight ! It had become too stressful and it was impacting on my health. I wasn't ready to face a tribunal to justify my cause.
I've mulled over my circumstances and really do feel that I have been harshly judged.
There is no cure for MS and I feel I do need the extra support that PIP allowances could bring.
Is there any way I can get back to further reconsideration?
Can I begin again with an application or should I wait until 2020 when my current claim ends?

You can make a late appeal up to 13 months after the date of the Decision providing you have already completed a Mandatory Reconsideration, which you have.

You will need to explain why your request is late, your health should be accepted as Good Reason.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and instructions on how to complete it, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

If you have further questions then please reply to this post and we will do our best to help.
