Hi, I'm a bit confused. I'm reading that you have to write,a letter for a reconsideration regarding my pip decision but when I rang them for the consultation report I told them I was going to go ahead with this but not to anything as I was going to write a very long report myself as reply back to the lies the assessor had put down. So do I now still have to write them a letter as I've just rang them again to check and they have a record of me ringing on 3 rd January to say this. He has also told me that I have 28 from this date of reconsideration and not the date of my actually decision which was 23 rd Dec. Please help. Thanks.

You can ask for the MR in writing or over the phone. However, if you just ask for the decision to be looked at again and don't provide any extra information it gives you an even lower chance of getting it changed. That is why we suggest you write and explain to DWP how/why you believe you should have scored points against the descriptors.

DWP should allow you extra time to get this to them.

I'm afraid I'm not sure what your '28' is referring to?

May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your PIP without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too :)

I have moved your post to it's own topic, we ask members not to post their question in other's topics as it can lead to the wrong advice being given or taken.

We advise claimants to request an MR in writing because we regularly see requests made over the phone being lost in the DWP systems, if you are satisfied that your request is being processed then there is no need for you to follow it up in writing.

If you are going to send in further information in regard the MR then as you have been told you have 28 days to do this from the date that the MR was request, however, if you can do so earlier then you should do so as the time includes postage and the information getting to the right person in the DWP.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi, I'm panicking a bit. My reasons for their decision were included in my first letter 23 rd Dec, but I requested the assessors report on 3 rd Jan. I was informed that that I would have 28 days from that request date. But I've read A guide to MR & Appeals which strongly advises me to stick with the time limit unless I have an extension letter, which I don't have. I am very stressed as I haven't finished all my report as 11 days were,wasted due to Christmas holidays. Gordon did help me yesterday regarding this but as I say I've just read the guide. Many thanks.

I have merged your post with the ones you made earlier today.

Forgive me but I'm not entirely sure what your concern is?

You have one month from the date of the Decision to request an MR, your earlier says that you did this over the phone and that you have confirmed that it was accepted in a subsequent phone call.

Having requested an MR you have 28 days to provide any additional evidence to the DWP that you want to be considered. The 28 days runs from the date that you requested the MR request.

Although they allow 28 days this includes postage time and the time it takes for your information to reach the Decision Maker so if you can, you should send it as soon as possible.

Hi, can't find this answer. Just to ask how long will it take for a MR for pip please. Also I've heard it won't be backdated if I do receive a good outcome. Is this true?
