PIP Award Higher Rate Care Standard Rate mobility

I am very sad. I went to Tribunal june 2016 they took my mobility car away from me then ( i am wheelchair bound) 67 yrs old with fibro.cfs osteo arthritis of both hips, shoulders hands etc. So this award came via the decision maker today,awarded from january,until i rang up,asking for it to be overturned to sept 2016.
I am in bits. As i thought i was going to havr my car back,as the copy if the award said i had 12 points mobi
Ity.
According to the Law,the decision maker said over 65 yr olds now ate NOT entitled to higher rate kobi
Uty. I need to know IF this is trye,as i wad raging at this man.
As it took me nearly 6 mths to gather info together to make my reconsideration viable to get the neceassary pounts. I live alone,and now this decision. I am in bits.Pleaee help.

I'm terribly sorry to have to tell you, but this is correct.

The legislation does not allow PIP claimants of 65 or older cannot receive a Mobility award if they do not already have one or an increased Mobility award if they have the Standard rate.

From your post, the Tribunal awarded you Standard Mobility last year, this new Decision cannot increase your Mobility award even if you meet the criteria for one. This is not an appealable Decision.

Thanks Gordon,the rest of the story is i HAD enhanced mobility form when i was 63 yrs of age until feb 2015.when my award ( up until oct 2016 wad called in earlt to feb 2016.and downgraded to standard,that was when i started putting in multiple reconsiderations on the basis that MY chronic health conditions never get better only very graually worsen.
My folly was going to tribunal in june 2016. But at NO TIME did any advocate point out to me the law about over 65 yr olds as they probably thought it didnt apply to me as i wasnt registering a new claim.
I have asked someone from their office to call me tomorrow,as it makes a mockery of thengatheting of all the evidence from physios,gastros,rheumatologists,neurologists,immunologists,and blood tests,and remember i suffer from brain fog daily,and i dont have a car now.
To be told,what is the point in filling in the mobility section of the PIP form if i am not entited to an award? Thats just pain insanity. Something is very wrong with the system.

It was the same under DLA so this is not a PIP specific change, the view is that as people get older they have more age related issues, these are not considered when assessing for DLA, PIP or AA.
