Hi all and happy new year to everyone

I previously claimed ESA and was in the Income Related group but my claim was stopped as the DWP realised I should not have been getting it due to a property that was owned by my husband.
The DWP did not completely close my claim as I have been told my claim is still "active."

My question is now that my husband no longer owns the property, as it has been sold to pay off our debts,will we be entitled to ESA again...?

I receive DLA high mobility and low care component and I am unable to work.my husband is in receipt of PIP at the low rate and also does not work due to his mental health, I am my husbands carer so we also get care Allowance. We have a mortgage on our property that we live in and we have a property abroad that has a mortgage and is rented out but the rent we get does not cover the mortgage so we have to add money to it.
We have one dependent child that is currently at college and will be going to University in September this year. So we get Child Benefit for her at the moment.

I would be very grateful if someone could give me some advice to ensure I am claiming the right benefits.. :(

You might be entitled to income-related ESA if you joint assets are now less than £16000. This would depend on DWP agreeing that paying off your debts was an appropriate use of the money raised by selling your property. The property you own abroad would also be taken into consideration - I do not know if they will consider just the equity you have or the full value.

This is one instance where I strongly suggest getting face to face advice, we cannot give detailed financial advice here on the forum.
