Whoever wrote up and agreed on the new law and questions regarding PIP assessments clearly lacked morals and any understanding of poor health.

For example......

Can you stand up, walk to the toilet and then wash your face, does not represent any health condition whatsoever. To even qualify for the criteria that these questions are asking would essentially mean you would need to be bed bound 24 hours a day, 7 days a week.

Anyone in that position would probably be in long term care at a hospital or a care unit and would not be eligible for PIP payments as the cost of their care would already be into thousands per week.

It's been crafted in such a way that it APPEARS that you can have a fair assessment, when in reality its far from fair or far from taking into account of ALL types of illness. Because someone can walk to a toilet in their house does not mean they are not ill. Nor because someone can communicate verbally does not mean they are not ill.

This is just a sample of what the state actually uses AGAINST you in a claim, and at the same time they OVERLOOK what evidence you actually have to justify a claim. Just because the CAPITA/ATOS assessor told them so......

The people that craft and write up these laws will NEVER be affected by them. When you are earning £200,000 + year as a MP, i am sure they will have enough money in their piggy bank to see them through poor health even after only working a few years and would never actually have to claim from the benefits system that THEY created.

I have sent off a letter for Mandatory Reconsideration and used some of the paragraphs used in the Benefits and Work packs. I have enclosed some additional copies of letters regarding past medicals that I have had. I hope to be successful in my claim. However, after reading the posts on this forum I gather my claim is likely to fail. I really dont understand how it is possible to be successful with a claim even though I have a genuine progressieve life long disability. My disability is little heard of and cannot readily be seen with the eye and I think this is the reason it will be unsucessful, it cannot be seen unless you spend time with me and a f 2 f assessment was taken in my home. I can not easily get out and not by myself. The report had many conflicting statements and never even mentioned my conditions by name.

The revision rate at MR is low, so you should set your expectations accordingly, however, members do get the Decision they want at this stage of the process, but even if you do not, know that the success rate at appeal is over 60%.

All though it can be tempting to deal with the assessment report first, please remember that this will not in itself result in an award, you must first show that you meet the criteria before you deal with opinions of the assessor.

Go back to your PIP2, with the assessment report on one side and PIP Claim guide on the other and make sure that you have met the requirements of the PIP Descriptors, not what it says on the form, the legally defined descriptions of what each activity consists of.
