PIP f2f assessment - consent for physical exami was created by plankgirl
Hi,
At my DLA-PIP assessment I said I was not happy for a physical examination as my last one (for DLA) caused a prolonged period of pain afterwards, even though the HP was very gentle.
The assessor just shrugged and said it had to be done.
By this time I was very tired and anxious and so did not insist it wasn't done....just went along with it ( with the resultant increase in pain. So much for 'Do no harm' that medical professionals are supposed to adhere to!)
Anyway, the repot states that I consented. I feel I was coerced. Is this worth mentioning in my reconsideration letter?
Also, legally, should a same sex 'chaperone' be available? At my DLA assessment the male HP got a female colleague to be in the room during physical, even though my partner was with me. This time I wasn't even asked if I wanted a 'chaperone' present.
Many thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

The obvious question is what do you want to do about this?
If you made a definite statement that you did not want to be physically examined, it's not clear from your post that this was the case, then you can make a formal complaint to the Assessment Provider and the assessor's professional body, you might also want to contact your MP.

You might want to have a look at the following.

As to a chaperone, I doubt there is a legal requirement, assessors would a most carry out a cursory examination, it certainly would not be detailed examination or what would be termed an intimate examination. If you did not request a female assessor then I think you would struggle to pursue the matter.
