Good afternoon.
I have now received the paperwork from the DWP to the tribunal in response to my application. There are additional comments in there from atos. They are very dismissive of the evidence I gave and I wondered if the tribunal will take their comments over anything I've put forward.
Also I have additional evidence and I wondered if this is now the time to sent it to the court?

Tribunal panels take a much more balanced approach to the evidence than the DM does.

Yes, you should now complete your own submission and include any new evidence that you have, all of your documentation must be with the TS no later than seven days before your hearing.

The additional comments were from atos,saying the DWP should not change the decision, so I wondered how they would view that?

Thank you I will send the extra info. off . I am absolutely petrified of going to the tribunal, I really don't know what to expect.

I would firstly like to thank you for all your help so far. It's great to have a website like this one.
I am now in the process of waiting for a tribunal date.
I have read elsewhere that if you take your main carer with you to the tribunal (this will be my husband) you cannot take them in with you as they like them to go in later on. Is this true?
Also I have read through the DWP'S submission and they state as follows " Despite medical evidence being supplied the decision was based on the Atos assessors report" I found this a strange remark as I thought they took medical evidence into account. Will the tribunal hold this assessor in such high esteem as the DWP ? If they do the same thing I might as well pack it in now.

Hi Pamela,

I have merged all your PIP questions into one topic as we ask members to keep everything relating to the same claim in one place.

You will be able to take your husband with you into the hearing. This not like a criminal trial where witnesses are not allowed to hear what anyone else says until they have given their own evidence. The panel will want to hear mainly from you, but your husband should be allowed to make a few comments, possibly at the end of the tribunal.

The DWP Decision Makers have no medical knowledge, so they rely heavily on the assessor's report. The Tribunal panel will be more interested in hearing from you about how your problems restrict your ability to carry out the activities associated with the descriptors, they will not pay as much attention to the assessor's report.

When you have further questions or comments about your PIP, please reply to this message rather than starting a new topic. You will find it easily in future if you bookmark/favourite it on your web browser now. Alternatively, if you click on your username (in blue when you are logged into the forum) it will bring up a list of all your previous messages :)
