Scared, worried and anxious!

I have had DLA (particularly the mobility part) for over 16 years. On Thursday I have to go to ANOTHER Tribunal hearing...... The last one was nearly 4 years ago where the Panel didn't even want to question me because the evidence was overwhelming in my favour... In fact they wanted to back date my claim further than they could!

Now you would think that the DWP would just transfer me to PIP without question.... If only! Firstly I was transferred and my Care award was decreased from the old Higher to Middle rates.... I still got Enhanced rate mobility and whilst trying to argue that I should have the Enhanced Care rate, I ordered another Motorbility car. The DWP looked again at my claim and found me entitled to a lower rate.

I will have (hopefully if she can get someone to look after her son) one of my carers with me as my husband is a witness and can't be with me throughout. Despite this I am so anxious and stressed that I am, frankly, suicidal. Mainly because if I die my husband and family will get a lot of insurance money. (I took out the policies many many years ago)..... and he wont have to look after me any more.

I am holding on so far, but could anyone help me as to how to behave at a PIP Tribunal please?

I know I've had one 4 years ago, however, I am much much more disabled, particularly mentally, than then.

It's really important to understand that the criteria for PIP is very different from DLA, for example the reasons for awarding the highest rate of care are fundamentally different between the two benefits, ad HRC award does not translate into an Enhanced Daily Living award for PIP.

Appeal hearings for PIP are no different from those for DLA, so if you have attended one for DLA you will already have a good understanding of they work.

I would recommend that you have a look at the PIP Claim guide to make sure you understand the criteria you need to meet for the awards you feel you deserve.
