If it is any consolation Hoopsh, they did this to me about my ESA. It wasn't a new claim and they had previously carried out a paper assessment in 2014 with the same evidence and knew I couldn't get there.

They had letters from the GP saying I couldn't attend a medical; one letter they had faxed over from my Dr's surgery 5 times and claimed never to have seen it!

Went to Mandatory Reconsideration and they wouldn't change it, which is standard. I am now awaiting an appeal date.

Please, please challenge it. They have worked out they can meet their targets and kick very legitimate and disabled people off of ESA by 'mislaying' medical evidence and claiming you missed an appointment and you had not given "good cause", for missing it!

The more they get away with this very sneaky way of finding people fit for work, the more they will do it. You can do this.

You gave "good cause" - they knew in advance, and you provided Dr's evidence, albeit not as comprehensive as you would have liked.

I would start by asking for a Mandatory Reconsideration. You 99% won't get it overturned on that, but don't worry. Then take it to appeal on the basis you showed "good cause".

If you can get your case to a Tribunal, you have a better chance of someone looking at your case logically.

You have nothing to lose and everything to gain from doing this.

Yes I did contact Atos, a week before the medical was due. I did this via email and recieved a response. I further sent another email to chase up as I had not heard back, also explaining the waiting was causing me more anxiety as well as further worry. I also asked if my benefit and claim would be affected or not for requesting a home visit due to being unable to attend the medical centre. Atos emailed back ignoring the questing stating that my email had been passed on to C.Relations.

My MP is absolutely useless. I've been trying g to get help from her for years regarding my housing as our property is unfit for human habitation but she just doesn't care despite knowing how bad it is and how bad it's affecting my health. She is famous for not responding or getting involved, as well as being clueless as she gets her PA or whatever they are to respond.

I'm so sorry to hear what you've gone through Mizzie. Like you, my health has also deteriorated due to the who process. While I understand and appreciate they have to follow strict guidelines, which they do, it shocks me that they can completely ignore medical evidence supporting a home visit.
It has taken me this long to read my replies as I couldn't bare to look and read.
In all these years, sadly the government have learned no lessons regarding MH and continue to discriminate MH sufferers like us. It's very hard and difficult living with the conditions of MH and other health problems as it is, so why are these government officials legally allowed to cause us further mental and physical distress? In this day and age? MH stigma will never change in the UK.
I really hope and pray you get it sorted out. I can't sleep, eat or think anymore, all I can do is worry. My family are so worried. Every waking moment, I worry, I dread the post on top of all my other problems.

Hey LadyLuna, so sorry to hear they did that to you too.
My brother contacted PIP, explaining what had happened. The guy he spoke to seemed nice and helpful. He said that my claim had not been closed, instead it would be sent back to Atos to be looked at again.
I complained to Atos after they sent me the letter stating my claim had been sent back but as yet have not heard anything back either from Atos or DWP.

My post doesn't come through my door. I live in a communal flat and our post box is below the floor from me but I'm not able to get to it and have to rely on my son or brother. So it can be days before I can get my mail.

So many of you have gone through the MR and appeal process, I don't know how you've all managed to get through it. So many of you understand and been through what it's like at this stage of when they ignore you. It's absolutely horrendous and traumatic. I can't even get to my GP because of how ill I am. MY Gp doesn't even understand or show empathy. I don't get to see him like I use to see my old GP from my previous surgery. My first GP u had when I moved here in 2012, was a female. She became pregnant, went on maternity leave, so I was seeing different doctors. The first two years went like that, until the main GP told me I had to see him from now on. Common sense really as when my GP came back from maternity leave part time, it was difficult seeing her, as I was seeing whoever was available. So I stuck to him, who was part time and difficult to get an appointment with. So over the years, I hardly bother seeing as I get the same old thing. I'm not getting better, I've got worse. How can I go and see my GP when I am not physically and mentally able to do so?
You are strong and well done for not giving up. I can't even bare to think about an appeal. I wish it would all go away. The constant worry and stress of it, is really badly affecting my health.

To confirm, your email explicitly stated that you would not be attending the appointment and this was the first appointment that had been made with you.

If this is the case then you should have received a second appointment although this may have still been at their offices.

You should include your email and the response in your request for an MR with an explanation that you expected a second appointment.

It's important that you understand that this Decision was not about whether you should have a home assessment it is only about your failing to attend a properly notified assessment.
