A question about PIP appeal was created by AndyG
I have a forthcoming PIP appeal and in the documentation and in my written submission I have stated that I am only appealing the Mobility element of the claim. I have already been awarded the standard rate of daily living allowance and I feel that is appropriate.

Will the tribunal look at the whole claim or will they just look at the mobility part of it?

The tribunal panel will have the right to look at your whole claim - but they might not do so, it is entirely up to them.

Have you had a look at our PIP guide? It clearly explains the criteria against which you are being assessed.

PIP help for claimants

May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your PIP without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too :)

Thank you for your reply, I have changed my name as per your instructions. My appeal is tomorrow so I am a little nervous but I will let you know how I get on. I am currently on the standard rate for both parts of PIP and as I said I am only challenging the Mobility part of it.

The HP's report was pretty poor I thought, lots of factual inaccuracies and other statements that were misleading. I have written a submission and emailed it in to the Clerk and have made a few additional notes to read out tomorrow.

My main contention is that I am not able to walk more that 20m without exhausting myself and causing myself considerable pain and while the HP talks about my physical ability doesn't discuss the effect or impact.

She also said in her report that I am on medication for my MS which is not true. The medication I am on is found in a number of cases to slow the advancement or progression of MS. It is not a cure or treatment and I think that gave the DM the wrong idea!

Good luck for your tribunal.
If you had been on indefinite mobility previously, try and supply copy of old award letter.
I am sure it helped in my recent appeal.

Hey,

It didn't go well although I didn't come out any worse off so that's something I suppose. It was not a nice experience at all as I felt all they were interested in was catching me out. I had my wife in with me and she felt the same way. To be fair it was the member of the panel with knowledge of disability that was the issue!
What I need to know now is should I put in a fresh request to have them look at my claim again? My last review was in July last year with MR in September and the appeal today. When does the 6 months start from?

I'm not sure what the "six months" you refer to is? :)

You can ask then now to look at your claim again, but you will need to show that there has been a deterioration in your conditions since the last Decision on your claim. If you do make a request then be aware that this is a full reassessment of your claim, new PIP2 and almost certainly a face to face assessment and like any new Decision, they can increase, leave the award as is or reduce it. A new Decision gives you a new right of appeal.
