PIP appeal date set, grounds never acknowledged was created by J The Divine B
Tribunal clerk has set down PIP appeal hearing for next month.

Tribunal Service repeatedly refused to acknowledge my detailed grounds for the relevant Activities despite grounds sent twice by recorded delivery.

A holding letter was sent prior to appeal submission deadline and stated:
1) Rep. would assist to complete appeal grounds before deadline---this was then done,
2) Rep. had taken detailed, accurate notes at previous PIP home visit.
3) Atos HCP had recorded substantial inacccuracies, diversions and had fabricated non-existent ability to walk specified distance in small lounge and had also falsely written in report had spent 50% more time on home assessment,
4) Failures by DWP regarding mandatory Reconsideration.

The Tribunal service and DWP have not acknowledged the grounds for appeal which were sent twice by recorded delivery. Phone calls have proved waste of time. the only interpretation is that both bodies are colluding pull the wool over the Tribunal panel, to have appeal struck out at very start of the hearing.

Perversely, the DWP fabricated and supplied to the Tribunal Service 'my appeal grounds and sought the appeal be struck out----the DWP fabricated that my appeal grounds (merely) consisted of the criticism of DWP dealings with Mandatory Reconsideration [not relevant to appeal grounds] and that I was claiming that it was my (court highly experienced/legally qualified) representative and amanuensis i.e., note-taker. who I accused of inaccuracies and diversions and fabrications.

Any ideas, suggestions what else to do?

I'm sorry but what confirmation are you looking for?

If you have submitted these issues as part of your evidence then this should have been copied back to yourself and the DWP, but other than this no action would have been taken. it is down to the panel, on the day to consider the points that you have raised.

These issues have again been sent to DWP and to the relevant Tribunal clerk. The grounds for appeal (evidence for more points for descriptors in the relevant activities) have never been acknowledged by Tribunal Service. My grounds for appeal have never been sent back to me, despite reminders. Tribunal bundle sent by DWP has omitted all my grounds for appeal.

Will just have to present submission detailing the he history in the matter.?
It certainly has messed up focusing on effective preparation and ability on the hearing day regarding the grounds. Perhaps, need to ask for adjournment on the hearing date if the Tribunal Panel has not been supplied by Tribunal Clerk's office (and by DWP?) my grounds for appeal?

Don't lose track of the fact that you will only receive an award by showing that you meet the criteria, showing the errors in the report will help but will not achieve this on it's own, also, be aware the panel are not there to hear criticism of the assessor or the DWP in how they managed the process.
