Hi mosala, I am in a similar position, having received 13 points for daily living and 4 points for mobility. I too have OCD plus other problems, I am severely restricted travelling wise, cannot get into taxi, on bus etc, I can go nowhere beyond a short walk to town, but failed to meet the descriptors it seems. I am not as brave as you, so think am sticking rather than twisting MR wise. But hope you get through your appeal with a good result, and would appreciate it if you could post on here how you get on.

I only got 12 points Daily Living, but I feel it should have been higher. Yes I took a risk because I strongly think I qualify for mobility 12 points. They didn't look at unreasonable time, repeatedly, etc. In fact they did not look at anything. I don't think they read it at all.

I am speaking with CAB on Tuesday to see what they think first. My OCD is severe and going out is a nightmare.

Have you spoken with CAB? You have already scored higher than me. Maybe you could go for it?

OK so if I were to go ahead and still appeal, even though they warn me I may not get Daily Living and then I lose Daily Living - am I able to appeal against the Daily Living bit again, (after the Tribunal) because it would be on new grounds, seeing as I have already managed to get 12 points, twice? In other words can it then be taken to the Ombudsman?

Hope this makes sense! :S

If a Judge warns you that your current award is at risk then I would take that warning seriously and consider withdrawing the appeal.

You cannot contest a Tribunal Decision because you think it is wrong, you can only take the matter further by showing that there has been an Error of Law in the making of the Decision
