:( hi my husbands pip form came back with no points at all, I have high rate mobility and low rate care , he has been ill now for 9 years, he has me/cf osteoporosis, asthma his adrenal glands don't work properly , my husband has just rung for a mandatory look again at the medical report. When he was at the medical the hcp asked if he could put his arms round his back this he finds very difficult, she told him iam glad you said that because people say they can not do it and she said well how do they clean there arse. I think this is wrong and if people like my husband have lots of problems with his toilet needs it should be dealt with compassion. Also do the hcp have to tell you what they do , she replied we can not tell you what work we do . I have been with your site a few years now and you are fantastic. Iam waiting for my medical we are worried stiff . My brain does not want to work I know that I have to help go through your forms and send more information in. Can I ask we asked what date does he get for sending things back ? The form says the 4 February , but she said from today the 15 February is that right please help .

Assessors are supposed to tell the claimant there qualifications but you cannot assume, even if they are a physiotherapist that they are not qualified to assess your husband.

You have one month from the date of the Decision Letter for the DWP to receive your request for a Mandatory Reconsideration, this needs to be done in writing to the DWP, to the office that dealt with his claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that he met the criteria, there are many reasons he may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that he walked 50m, he did but they have failed to document that he had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
