Please could someone help me at all? My daughter was on ESA now put onto JSA. we are appealing for a reconsideration at present. She suffers with Non-Epileptic Attack disorder (N.E.A.D), Syncope, muscle spasms, arthritis and other illnesses. The stress has made this alot worse (this week alone had to call ambulance to her). The GP tried to do a fit note and put the illness NEAD down and had signed her off work for 1 month and told her to go back again after the month. He also told her she must have someone with her when she goes out and preferably when at home too. We gave the jobcentre the fit note. Daughter then received a phone call from benefits and told they will not accept the fit note as this is the same illness as before ( she had been on esa for quite a while, but Nead is an ongoing illness and we do not know how to get the benefits to accept the fit notes as she is not well enough to do the work IF she has thes seizures which is usually at least once a week with multiple seizures at a time. sometimes twice in the day The last one recently was 18 seizures! This leaves her memory confussed and her physically exhausted. It takes her 2/3 days to recover with others trying to help her with household tasks and reminding her. She has never refused to work and has been trying to do voluntary work, but has had seizures there also and we have been asked to collect her. Can anyone suggest what to do regarding the fit notes? She has already tried returning to the GP, but he said his hands are tied and benefits would personally have to contact him to demand what information they required.

There is no legal requirement for the Fit Note to be for a new condition.
I would re-present the Fit Note, if it is refused again, then ask for the matter to be escalated and for a copy of the JSA Regulations which specifically refer to this requirement.
