DLA to PIP failed MR was created by JLC
I just rang DWP to see if they had received my MR (having telephoned on Tuesday and being told it wasn't even on the system) and I have been told that a decision was made yesterday and a letter sent out yesterday.

When I asked what the letter was he said it was a mandatory reconsideration disallowed letter. I am actually wondering if they read my doctors report that was included. I now have to decide what to do as I am limited on what more information I can get.

I'm seeing my chiropractor on Tuesday for some advice on the assessor report that was compiled by a physio as there are details about my joints (angles etc) which don't make sense to me, so she may be able to pick it apart.

I'm tempted to do a paper tribunal as I'm not sure if I can get to the tribunal itself (I suffer from bowel stress). Is this recommended? My motability car has to be returned by 28th March and I am not sure when I will have a car.

If you can then we would recommend that you attend your Tribunal but you must consider whether your doing so will counter some of the arguments you might make for an award. The success rate for a Paper hearing is a lot lower than for an Oral one.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
