Hi, Im the appointee for my son, we recently had his PIP f2f and have received both his assessment report and award. He was luckily enough to be awarded enhanced care but only 4 points for mobility.
The main problem is the assessment seemed to be based only on his mental health issues and not his long term bowel disorder, the assessors didn't take into account the pain that he is constantly in at all. Also there a lot of lies in the report, which makes me very angry.
I have just sent off an official complaint to ATOS and have also complained to the Nurses & Midwife's register but am at a loss of whether or not to go for MR.
I just keep getting told that he could lose the award he already has, is there anyone that I could talk to and get some advice?

PIP Mobility looks at four things

The Going Out activity considers

Planning a route - this is primarily a cognitive or sensory (e.g. blindness) activity. You are being asked about the problems he would have with working out how to get from one place to another, he does not need to be able to follow the route that you are planning..

Undertaking a Journey - this is do with mental health issues such as agoraphobia and social anxiety and is concerned with him leaving the house to go somewhere, they will be interested in the things that stop him doing this. You need to show that you would suffer "overwhelming psychological distress" to meet the criteria.

Following a route - the DWP regard this as a cognitive or sensory activity to do with navigating the route, SO are there problems that would prevent him from doing this?

The Moving Around activity looks at the claimants ability to stand and then move (walk).

What did he score the four points for?

The DWP will look at both components even if you only ask for them to reconsider the Mobility one. IT does not happen very often, but we do see members report that they have lost points at MR.

Hi, ive changed my name, thank you.

He got the 4 points for Planning and following a journey, I personally feel he should have got e but of course they are changing this criteria soon!

As I mentioned before he has a long term bowel disorder and he has a lot of stomach pain on a daily basis and if often unable to walk anywhere but on the assessment all she mentions is that his MSO is ok but of course it is as that isnt where his illness is?

If he scored 4 points for the Going Out activity then you would need to show that he is unable to go out at all due to overwhelming psychological distress to score higher, or that his mental health issues are so severe that they affect his ability to follow a route.

To score for the Moving Around activity you will need to show that pain limits the distance that he can walk. He is not required to walk pain free, so the pain must be sufficient to stop him. For DLA, the pain must be related to his walking and not some other source, there is no Case Law in this area for PIP but the Decision Maker may make the same argument. At the very least you really need to show that the pain is exacerbated by his walking.

Is it worth phoning the DWP and asking how they came to the decision when they have ignored his physical illness? and if I did this would it trigger an MR (as Im not too sure we are going to do this yet)?
