PIP appeal situation was created by Carolkitty
Hi, gave lots of medical evidence with PIP claim, still failed after medical, requested MR, then they wrote me asking to send in medical evidence, new and current I presume,
I did (and it cost me) and sent it by their deadline and have proof signed for, received their MR decision saying failed again and that they did not receive medical evidence.

Now what to do? Just comply with the Appeal process? Or chase up DWP about why the new evidence was not used, complain?

Also asked them to use my DLA evidence for PIP claim, and they said they don't have anything on file. How is that possible if I've been on DLA? This is a transfer from DLA to PIP.

The reality is that revision rates at the MR stage are very low, probably less that 10%, success rates at appeal are over 60%.

You can ask for a second MR, but be aware that the one month to request an appeal will run from the date of the first MR letter.

The DWP regularly destroy old evidence, this is likely to be what happened to your DLA information.

Thanks, so shall I write to DWP asking for second reconsideration, at same time as sending off the appeal?

Would it help if I include previous DLA award letter, as support evidence?

There's really no value in doing both, ask for a new MR or appeal, if you request the appeal then the DWP can still make a more favourable award if new evidence or testimony justifies them doing so.

You can use the DLA award letter, but I would not expect it to carry any weight, the assessment criteria for PIP are fundamentally different from DLA.
