Dear all,
I wanted to let you know that three weeks after sending my MR letter I have the dreaded brown envelope !
I went from DLA to PIP and had the mobility component taken away completely.
I got copy of assessor a report which bore very little resemblance to what was said. Using the info in the B&W literature I wrote out my MR letter, but was not hopeful as I was just reiterating what I'd said in my very detailed claim.......Before I sent it off I thought I'd do a last check on advice here and found that I had not looked at one of the manuals which detailed 50 appeal points. I am so very glad I did as I believe that the info here was what swung it ! I checked the 'evidence' the HCP had stated he'd used......maybe I'm naive but it didn't occur to me to check this, I mean, they wouldn't get something so basic wrong, would they?
Indeed they had, the 'evidence' was listed incorrectly, and references made to my claim form, Gp report and other medical reports were so vague as to make me conclude that the HCP had NOT looked at any of it and had based his report on the assessment only. Thanks to this guide I was able to challenge HCP report on many errors and omissions........
the result? I went from 4 points on mobility to 21 points ! In addition, although I did not challenge the standard rate care award, the decision maker looked at all the info and increased it to the enhanced rate !!!
Thank you so much to the B&W team and the excellent guidance provided, well worth the subscription! I honestly feel had I not looked at ALL the info provided I would be preparing for a tribunal.
It is so hard to challenge the dwp decisions - I nearly gave up several times as I found it so stressful and upsetting, but stick with it if you feel they are wrong. I think they take awards away from people in the hope that we would find it too hard to challenge them. I think my story shows that it can be worthwhile.
