When ESA comes to an end and mental health was created by moutainsandoceans
Hi,

Short background:

My initial ESA claim began in June last year.

Although I was given 0 points, and my report didn't seem to think I was 'unfit for work,' I was called up and informed that I would be put in WRAG. For 6 months.

I had 6 months, went to a work advisory app. every fortnight. And then in January had to fill in ESA50 a second time. Then attend another WCA last month.

I have a strong feeling I will score zero points and be taken off ESA in the next few weeks. What happens next?

I'm not ready for an intensely gruelling tribunal/appeal process after what I'm guessing would be a non-resulting MR. But the alternative is being on JSA and being forced to work...

My question:

I understand I'd have to claim JSA while MR is processed, but since I'm in the work programme for two years like everyone else who is on it, my question is, once I'm put on JSA will I have to attend the provider Seetec more than I already do now on WRAG ESA?

It makes me intensely anxious.

You don't have to claim JSA but it will be the only benefit available to you if you are found Fit for Work.

Your claim will be a full JSA claim although you may be able to negotiate a limited Job Search agreement, being on JSA they will treat you as a fit person in regard the Work Programme.

However, once your JSA claim is accepted and in payment you can present a new Fit Note and be excused any activities for up to 13 weeks.

Be aware, if you live in a fully active Universal Credit area then it will be UC rather than JSA and the rules are very different.

So I feel that if I'm found fit that I have no other choice as I'd need the money.

Since I'm in the work programme for two years once I'm put on JSA will I have to attend the provider Seetec more than I already do now on WRAG ESA? Or will the sick notes limit how much I'd have to go?

Oh and lastly on the UC front, how would it differ?

If you supply a Fit Note then you should not have to perform any JSA activities.

As I said, you will be treated as any other claimant for JSA would, this can mean that your involvement in the WP is increased.

UC limits your sick leave to four weeks , also if your ESA claim was an Income Related one, then you will be put on ESA under UC if you go to appeal or the Decision is revised in your favour.

I see. That really worries me.

I know you mentioned I wouldn't have to perform JSA activities in the first line. But increasing intensity of the WP is what I dreaded. Those daily meetings with the programme's supervisors worses my mental health issues. The job center fortnightly/weekly computer visit would actually be less of a pain for the weeks I was doing the MR.

I guess there is no advice for how to handle the WP issue if my ESA stops and I have to apply for JSA?

Perhaps you are focussing on the wrong thing, If your claim is successful then you won't have to worry about these things.
