ESA Appeal was created by jason j
I was put on ESA then in support group for 1 year then given another ESA Medical assessment having had 6 dwp Medicals over years I was aware of what would be asked of me,and exercises that would take place ,and what i cannot do and what i am able to do. i then read to my surprise i had failed only scoring 9 points for mobility?I get pip high rate on both components. On reading the medical report the medical examiner has written at least 8 lies, also scored me 0 on several exercises that never took place ? At this medical i had 2 witnesses i brought in with me. also i can account for Every Question And Every Answer Given during that 48 minute and 33 second ESA Medical. I have asked for an appeal My question is hypothetically of course is, if a recording had been made accidentally made could it be used in my defense in my appeal? to tell the truth about this Medical assessment and the nurse involved ? You tagged your post on an informational post by the Mods!!!!
You can make the Tribunal aware that you have a recording of the assessment but it will be down to them to decide whether to admit it or not.
Tribunal panels are a lot less interested in what when on at the assessment than they are to hear from you on the day why you think that you meet the criteria for an award.
If you want make some use of the recording then you can transcribe relevant sections of the report and submit them as written testimony.
