Is there any point? was created by soxie
So today I got a letter from dwp it was a copy of their letter to the tribunal service responding to my request for a tribunal, in it they noted I had contested what actually happened in my assessment i.e the face it was fiction and said that they stood by the assessment and I was the one who was not truthful and they asked for case to be dismissed. is this normal and how come they can just come right out and call you a liar. What's the point of even going on now when the tribunal have been told this.

It's pretty standard, they are expressing an opinion that does not mean that the Tribunal panel will agree. I would expect that 99% of claimants who appeal, disagree with the content of the assessment report.

They say Mrs T said she never walks unaided our assessor observed her walk 30 metres unaided, Mrs T said she cannot raise her legs from a seated position our assessor says she did this with no problem. These things never happened the end of the letter says therefore we stand by our assessor and ask you dismiss Mrs T's account. So with out actually calling me a liar they are calling me a liar.

They are favouring their own evidence, this is perfectly normal, you wouldn't be going to appeal if they preferred your evidence. This does not mean that the Tribunal panel will take the same view.

You have an opportunity in your submission to the appeal to explain why you never walk without assistance and they will ask you about this at the hearing, so you will have an opportunity to set the record straight.
