Hi Gordan

With regards to Q15 going out on the esa form

My daughter has epilepsy and gets DLA low mobility for not being able to get around unknown places so you have told me Q11-17 is for mental health

But she also has a personality disorder and Severe depression and Mixed anxiety would the following be considered or not as meeting the descriptor sorry to take up your time I am wondering whether to not bother with this she has had a letter today saying it has to be back by next Thursday
Q15 Going Out.
Amy needs people to go with her because of her epilepsy when going out to places she doesn’t know that are unfamiliar. She either goes with her sister, friends or I take her, to ensure she gets there safely and on time because of the risks of a having a seizure with traffic. She doesn’t like the feeling of being supervised as she is an adult now so as much as possible her sister goes with her instead of me taking her unless she can’t or is not available. Amy does go out to friends and local shops but mostly she is with her sister or friends, but at times when out can become very anxious and scared because of her past or if something happens will panic and get distressed. Amy’s anxiety causes her to be fearful of going places in case she sees people who might abuse her or threaten her as she has been through a very bad abusive and violent relationship suffering a lot of domestic abuse and violence which has had an effect making her very scared at times. being fearful of bumping into her ex- partner or his friends as he has turned a lot of people against her and they have made threats against her, Amy has a non- molestation order but has still been abused and threatened by his friends even with this order. She is frightened because of this and what they will do. Due to her personality disorder, if things happen when out what is stressful or confrontational she panics, gets distressed, emotional, abusive to people and shout or swear through fear they will hurt her or feeling they are against her or just through misunderstanding taking things the wrong way. With regards to going appointments I always take her as it can be stressful and cause her increased anxiety about going and because of her blank episodes and seizures. When she is having bad days due to her Depression and being too low just has no motivation to go or caring what will happen if she doesn’t go would just not care about going no matter if it was important, not realising about the consequences of not going such as if it was an appointment for a work focused interview and getting sanctioned, not receiving her benefits, have no money for food then not being able to pay her bills and losing her home she doesn’t understand or care about the consequences and seriousness of what’s involved and how if she was sanctioned what effect this would have, Her medication can make it hard to wake in the morning as she has had a lot of difficulty sleeping because of nightmares about her past relationship waking up in fear thinking he is there. She can spend hours depressed thinking about her circumstances not realising the time unable to switch off to sleep and then realise she has missed an appointment or is late so We try to keep on top of everything she has to do to try to keep everything in place and everything in her life as easy as possible for her to keep her calm.

If you can show that she meets the criteria for Q15 because of her mental health issues then do so, anxiety that derives from her Epilepsy is fine but do not refer to the Epilepsy directly, this would be something to cover under Substantial Risk where this delineation between the conditions that cause her problems.

Hi gordan thanks again

its hard as the way she is a mixture of all her conditions

She is very depressed daily just by speaking to her can cause a massive over reaction resulting in verbal abuse and then self harm
then shewill be blanking out because of her epilepsy

she is fearful of going places because of her past but when she is having a manic episode because of her personality disorder she doesn't think clearly and is not aware and will just storm out the house or out the car

she has difficulty learning and understanding
we think this was because she had epilepsy and some mild learning difficulties which could be caused by her polymicrogyria which can cause mental retardation its a condition where in the womb the neurons in the brain when being formed in the fetus don't land in the right place its a condition we are not really sure about and only have a diagnosis and was told this by her neurologist
The Neurologist when he diagnosed her with this he said basically she has excessive grey matter in the right hand side frontal lobe part of the brain and this causes her to get things mixed up what she hears makes it harder for her to process information
more serious cases cause cerebal palsy and things like that

Then there is her severe depression and everything she has been going through with her past relationship from domestic violence and abuse and then him taking her son and a year going through court to fight for custody which somehow he got him when she was the one who had cared for him from birth he is a criminal with many convictions god knows how he got the child I will never know she is very loving and caring to her son and worships him

so somehow I have been trying to put all this into this stupid ridiculous unfit form

It just how to apply it and where

The polymicrogryria for instance I don't know if that's whats causing her al the confusion and her not hearing and understanding all I know is its the brain that's affected by it

I don't know if I should be saying this in Q6 Q7 or 10 or in the mental health parts

She has always had difficulty with learning but does that come under metal health q11 affect Q13

We used to think it was her epilepsy but when I googled it it told me it can cause all kinds of problems from mild to severe forms of mental retardation or cerebal palsy is that physical or mental no idea
I don't know if she has frontal lobe epilepsy or temporal

I have a diagnosis of Localisation related epilepsy and she has absences Partial complex partial and in the last year because of all the stress Secondary generalised where she has been dropping to the floor losing full consciousness and bit inside of her cheek

then with the frequent sometimes daily manic episodes of verbal abuse self harm and suicide attempts or punching doors throwing things etc
Because of losing full custody and only see him 2 days is causing her to be either major depressed or worst thing that can happen to someone with Emotionally unstable personality disorder as they form attachments beyond the normal and hate rejection and loss

All I know is I have to send it back by next Thursday and doctor only doing a report for Monday Useless I might just have to send it without as if it doesn't get there they will stop her money and she will lose her house and that I fear will top her off and I fear for her greatly
I only have limited letters with dignossi and some information from when she was under the recovery team which her therapy ended in January and now we have persuaded her go back she has doctors and has telephone appointment Monday to get referred back to mental health

Sorry for all the questions and mithering as you can see I am stressed to the max with this form worst and hardest thing I have ever had to do in my life

Hi Gordan whats this substantial risk do they decide that as I have had enough of this form and just want to print of what I have wrote which is over 6000 words now

Thanks for all your help your a saint just hope what I have wrote keeps her in at least the work related activity group like now even her advisor when she has seen Amy has told her just stay as you are if only but its not up to her its up to this maximus who get large amounts of money for kicking vulnerable people off at the request of the government

sheers again Gordan just going to print it off in morning and send it
