Mandatory reconsideration on one descriptor

Hi,
I have just received my initial PIP application result and I am thinking of requesting a mandatory reconsideration. Under DLA, I received middle-rate care and higher-rate mobility. I have been awarded standard on both under PIP (10 pts each) and as a result will have to give back my motability car.
I know that the reconsideration will look at the whole application. Overall, I think it's quite a fair assessment but I have received 0 points for getting around for which I disagree. I followed the guide and stated that I have real problems getting around on public transport as I have had numerous falls, stumbles and trips whilst on buses and trains (not to mention falling onto other passengers and stabbing them with my walking stick while grabbing for a handrail) . I have left sided weakness following a stroke and really struggle on public transport especially on trips to unfamiliar places as I get anxious that I may fall over as I can't safely get to a seat before the bus pulls away. I'm even worse getting off as I can't safely get off due to being unsteady and risk falling over when buses brake or pull in to a lay-by bus stop amongst other things. I've got a system where my wife helps me on journeys but only in specific circumstances where we know there will be seats available.

Should I write requesting the reconsideration saying that I don't feel that scoring 0 points for descriptor 13 accurately reflects my disability and the safety issues I have while travelling on public transport given what I've already provided? Also, should I say that I believe that Q13d should apply (Cannot follow the route of an unfamiliar journey without another person, assistance dog or orientation aid.)

I'm sorry you did not get the PIP decision you believe you deserve :(

I have 2 points to make

1) The Public Transport issue is not actually part of the legislation and DWP tend to dismiss it. In order to persuade them of your limitations, you need to describe your problems with walking in general rather than concentrating on your inability to use Public Transport.

2) Descriptor 13, in general, applies to people with sensory, cognitive or mental health diagnoses. 13d, in particular, relates to people with sensory issues such as visual impairment.


May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your PIP without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too :)
