Hello,

I have asked for a mandatory re-consideration for PIP mobility. I have currently been awarded PIP standard rate.

Here's my argument why I should be awarded PIP enhanced mobility.

I cannot follow the route of a familiar journey without another person, an assistance dog or an orientation aid – descriptor F. I struggle to undertake any journey and when I do, I get lost if there are any changes to the route on any route. This includes my therapy which has now been suspended because I am unable to follow the route and if there is no parking then I get extremely agitated and sometimes the Police end up getting involved as I lay on road. Please see attachments for examples.

I will try not to go out because if there's a diversion I get lost and end up and getting confused and the public get concerned and call the police for a welfare check on myself. This demonstrates that I should be entitled to mobility enhanced rate for the same amount of time as this has been going on for many years and is not changing.

The decision maker also wrote in my award letter that I have difficulty planning and following journeys- this should immediately be given though for the enhanced mobility rate of PIP. I have to be with someone else to go on routes if I go on any which is rare.

I also have Obsessive Compulsive Disorder which means I have to count when I am on a journey, such as the steps I take in my head and making sure I don't step on a crack. This makes it very hard for when I do go on a journey.

I understand new descriptors are being put in place on 16th March 2017 but my mandatory reconsideration logged 15/03/2017 supersedes this.

Also because of my OCD this is a cognition impairment which makes it impossible.

I feel therefore, my PIP standard mobility should be raised to enhanced as I struggle with journeys, but the journeys I do go on I need extra assistance and end up getting distressed and would need to pay someone to be with me, hence what PIP is for.

I have also attached proof that my therapy is on vacation but I need to make you aware that it's not just the therapy, it's my day to day life and journeys affected so I feel an award of enhanced for the same amount of time should be awarded.

I did send in an original letter saying I feel I should be applicable for enhanced mobility with my original award.

Do you think this gives good reason for higher rate mobility? Also, what are the chances of the PIP mobility rate being taken from me all together? I still stated as above I don't make journeys majority of the time but when I do these things happen.

I don't think that there is anything wrong with your reasons, but I do think you need to be prepared to take this to appeal.

What points did you receive for the Standard rate?

If it was 10 points for Descriptor (e) then you may struggle to score the 12 points for (f), as these are considered to be mutually exclusive activities.

I did receive 10 descriptor e. What do you mean by mutually exclusive activities? Thank you.

Do you think they might take away the whole mobility part anyway?

If you received points for Descriptor (e) then you are considered to be unable to go out, it is likely that the DWP will argue that if you cannot go out then you cannot be considered in regard to having problems following the route to a familiar place (Descriptor (f)).

Conversely, if you cannot follow the route to a familiar place then you must be able to leave the house and therefore cannot score for Descriptor (e).

It would be unusual for the DWP at MR to reduce the points already awarded, however, they can do this and we do see it happen on an irregular basis.

Ok thanks. So will they just have to look at the evidence again and decide whether to stick with e or move me up to f. I understand what you're saying. It does say on my report though that I struggle to follow a journey that I know so I thought descriptor f.

I struggle with going out but when I do I have these problems.

We'll see what they say but I understand I might remain in descriptor e, I am a bit confused with it all really. Hopefully they won't reduce the mobility.

I have argued that I don't go out, descriptor e, but when I do it's because of descriptor f. I understand that the majority of the time I don't go out, descriptor e is majority of the time but it's because of descriptor f, I cannot follow the route and any changes I go crazy and Police get involved with evidence.

Confusing.

Hi Alex,

Yes, someone will look at your claim again and decide whether to change the decision or leave it as it is. I must warn you that it is uncommon for the decision maker to change the decision at MR :(
