Hi

I am a newbie here but today I finally got the dreaded brown envelope with the decision on my dla to pip exchange. I was currently on dla High care and high mobility indefinately. Today I have been awarded standard care and standard mobility so now face loosing my car. I have put in a phone call for mandatory reconsideration and am in the process of writing the letter. Reading through the decision letter I am actually laughing..... In one paragraph they state in examination I have reduced lower limb strength along with hip and spine flexion. 2 paragraphs down the same letter states that on examination I have no problems at all with my lower limbs this is despite an independent OT report and my car being hand controlled due to my problems. So as well as the reconsideration I am also going to be contacting my MP Matthew Hancock in the morning for his opinion on his governments findings because obviously there were 2 of me in the room.

Anyway thanks for listening and if anyone has any advice it would be greatfully received. Thanks B & W for this site it has been very helpful. Xx

You should certainly deal with the major issues in the assessment report, the contradiction in regard to your lower limbs as an example, but don't lose track of the fact the you will only receive an increased award by showing that you meet the criteria for one, so I would recommend that you start by going through your PIP2, the assessment report and our PIP Claim guide to ensure that you have shown this.

In particular make sure that you have made use of the terms under reliably as appropriate and that you have also shown that you are affected on the majority of days if this is the case.

There seem to me to be an awful lot of Assessments carried out by HCP's who hace not folled their professions requirments to maintain high standars of Care and Dilligence.

If the HCP as Contradicted temselves and then stated you are able to carry out a task that Disabilities would prevent you being able to carry out You should make s formal complaint to thr HCP;s Registration organisation

General Medical Council (GMC)for a Doctor
Nursing and Midwifery Council(NMC) for a Nurse
Heath Care professiionas Council(HCPC) for other HCP 's

I phoned to make sure they had received my paperwork (even though I knew as posted recorded delivery) they received all the paperwork on 21st for mandatory reconsideration and made the decision on the 22nd to leave it unchanged! So 24 hours to make a decision. I spoke to a case manager and said I did not think that 24 hours was sufficient for them to assess everything and make a decision but they were adamant the award remains unchanged.

Therefore I will now lose my hand controlled car and some money which means I lose the little bit of independence I did have as cannot afford to replace the car. Now to appeal but as this could take months i can't help feeling really down. I will be studying your files closely to help me with the appeal and keeping my fingers crossed.

Hi Amanda,

I am sorry - but not surprised - that the MR did not decide in your favour. It is unusual for it to do anything other than 'rubber stamp' the original decision. I am particularly sorry that this will mean the return of your motability vehicle :(

As to the speed of the MR - your MP might be interested to hear how this was dealt with

Thankyou.

I have been in contact with my MP even before I put in the mandatory reconsideration request and have informed them today that the decision was made very quickly and am awaiting their response.
