MR still no points was created by Banness
Good morning
Well I received the dreaded evelope after asking for a MR. Still no points.

I had gone through each descriptor and typed a letter saying why I disagreed with the score of 0
My neurologist sent a very strong letter explaing that patients with ms suffer from fatigue and to push me back into work after 17 years would make condition worse.

To have had to end my nursing career due to ill health I am now in a posoition of having to find employment as I have to sign on JS but only getting NIC paid.

I am scared of appealing as I have no further evidence

An appeal will look at your claim from scratch so it is not necessary to have new evidence if you feel that you have already presented your case in the original claim form and the information attached to it.

If you do make an appeal then you can ask for your ESA to be re-instated at the Assessment rate until you attend a hearing.

The ESA Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

If you have further questions then please reply to this post and we will do our best to help.

Unfortunately my claim form was filled in with the help of cab last year. Every answer was it varies. My mr states you didnt put this on your form when i disagreed with descriptors. I was put into the support group 5 years ago without a face to face and my consultant has stated my condition has worsened. I dont feel I can offer any more than i already have. I cetainly wish i had found this site earlier. I dont think i could win an appeal so its looking like back to work for this lady

I don't think this precludes you from making an appeal, although you would have to explain the discrepancies between your form and what you are now saying, given you don't have an award you have nothing to lose, although I won't try and minimise the stress that an appeal can cause.
