I have just had a letter from DWP answering my question to them regarding no points award under Communication Descriptor even though it was recommended in the face to face assessment.

The reason they have given is that because I wear 1 hearing aid and I could hear clearly by wearing one I am not qualified for any points to be awarded. Apparently they have cited that their guide clearly states that if a person is wearing 1 hearing aid and they are able to hear what is being said then they are unable to award any points for communicating.

I am not sure what guide they are referring to which says no points can be awarded if a person is wearing 1 hearing aid only. Is there such a guide that DWP follow and would I be able to request an extract of the guide which mentions this particular point?

They are likely referring to the PIP Assessment guide. there's a copy in the PIP section.

Page 117 says in regard to Descriptor (b)

For example: may apply to claimants who require a hearing aid


Hearing aid being in the singular.

However, the key question is what you can hear without the hearing aid in use versus what you can hear with it. If you can't hear reliably without the use of the hearing aid and you can with it then it does not matter whether you use a second one or not, you require one to be able to hear and therefore meet the criteria.

From your reply it is clear that case manager who has replied is not following their own guide on this descriptor in its full context as it should be.

I have hearing loss in both ears although my hospital provided with one. The Health Assessor in the assessment report has also mentioned I have significant hearing loss and will need to use my hearing aid for the majority of the time. This seems to be ignored.

I will reply back to the DWP and the case manager who sent me an explanation to look at their guide on this descriptor in its full context.

At this stage I will not ask for a Mandatory Reconsideration because I have my award. However I will keep a record of all my letters to them and their replies in case I need to take this up at Mandatory Reconsideration or appeal depending on the outcome of my renewal when it is due.
