Hi all Im new to this so please bare with me. My mother was on high DLA both components. We applied for PIP and she had her assessment done at home on her GPs request on the 3/1/17 the assessor's appointment was supposed to be between 12pm and 2pm. On the morning of the assessment the HP called and spoke to my nan and stated that she was outside and could she do the assessment it was 9am my nan agreed. My mother was asleep downstairs in the front room as she cannot manage stairs and is waiting on a stair lift. The HP lied and said she observed my mother from walking from upstairs to down stairs and stated that is about 15/20 metres that's untrue also she saidyou mother used her frame to get from the stairs to the living room another lie HP went on to lie more. My mother was awarded 0 points. We asked for a MR explained that will be sending in GP evidence. Had until the 3rd March. Sent in by special delivery and it was received by the 2nd and signed for. Got a letter back saying because the evidence was not received they have gone on the information they have got awarded standard mobility.I phoned and spoke to someone from DWP and was advised that they looked at the decision again and looked at the GP report and awarded standard care and standard mobility. I feel that my mother's health conditions have not been treated fairly. I would like to tAkeley this to tribunal. Can someone please advise

PIP was engineered to be a more difficult benefit to award than DLA, its stated intention is to reduce the disability budget by 20%, as a result you cannot look at mother's DLA award and use this as a benchmark for what she should receive under PIP, for example DLA HRC is awarded for fundamentally different reasons that PIP Enhanced Daily Living.

That doesn't mean that your mother is not entitled to the Enhanced rates but you will need to show that she meets the criteria for this, so the first thing you need to consider is whether she can score the extra points for the Enhanced rates?

If you think that this is the case and that you can reasonably show this then she should consider making an appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
