Which guide to use for ESA renewal form? was created by Francisca
Hello......
This time it's my husband's ESA renewal and I'm really confused. His last ESA 50 was signed and dated 27/2/13 . It went to mandatory reconsideration which was extended timewise until June 2013. (In case it matters, in the April, he had also received a 'Termination of Incapacity Benefit Claim' P45 from the jobcentreplus and received his first ESA payment in the May - so perhaps that was the official changeover date once the claim was granted - he didn't stop receiving payments at any time.
I'm confused by the dates for your guidelines (even more than last time!), since his form was ESA50 01/13, which doesn't fit with your old guides, but I'm reasonably certain I used the Old' ESA50 form, decision on or after 28 Jan 2013.
Which do I use this time round - the old one or your latest guide - physical_wca_nov16_v23.pdf ?
I'd much appreciate guidance here - already exhausted - I've done my own form twice since 2013! Can't wait for DLA changeover.
Many thanks
Frances

Nothing on this board constitutes legal advice - always consult a professional about specific problems

HI Frances,
Every reassessment should be treated in the same way as the initial application. In particular, do not assume that the assessor will have any prior knowledge about you are your claim. Make sure each question is answered in full and supporting documentation is supplied again if need be.
You should always use the most up-to-date version of the guides, it does not matter when the claim began.
May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your husband's ESA without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too

Hello Mrs Hurtyback!
Thanks for your fast response. I've bookmarked the page.
Could you just clarify - can I therefore from now on ignore the now archived comment and advice which says:
"Use these guides if you completed an ESA50 marked ESA50 03/11 in the bottom left corner of the first page: these were mostly sent out to claimants prior to January 28th 2013, but some were sent out later; and the initial decision on your claim has been, or will be, made between 28th January 2013 and 27th July 2013, inclusive"
Are these old guides now completely out of date?
Many thanks

Toadlet
You need to use the latest guides at the top of the ESA section.
