Refusal of PIP (transfer from DLA) was created by Millie'smum
HI. I'm a new member who is helping our daughter to appeal to PIP tribunal as she has been refused PIP regarding her language processing difficulties and problems with short-term memory, which she received DLA for since middle school (now age 23 years). My question is does anyone know what questions should have been asked at her face to face assessment re. her condition to prove 'normal cognitive ability'?
Also, we completed the PIP application when it transferred from DLA and sent in several reports and statement of Special Educational Need but they all related to her school years, age 9 and 14. Now she is an adult, we are going to pay for a private assessment as they are saying there is no evidence of impairment. They also state she can make complex budgeting decisions, but did not test her or give her any tasks to complete. Has anyone had any experience of these kinds of learning difficulties which are very much 'hidden' until it comes to actually doing them?

There is a list of the questions that we would expect to be asked at an assessment at the back of the PIP Claim guide

www.benefitsandwork.co.uk/help-for-claimants/pip

but there is no legal requirement for these questions to be asked of for particular areas of a claimants capabilities to be explored, so if you are hoping failings by the assessor to enquire into these areas to help revise the Decision then I think you may struggle.

What activities did you expect her to score points for?
