did not need to appeal nor was I called for a medical prof hughes was my dr and had wrote a couple of the reports on all the tests carried out I also had reports from 5 other hospitals on other different health problems which are best described as main stream getting 23 care 22 mobile points 10 year award

Hi Franny66,
I have SLE lupus and I am also UV light sensitive. I too get blurred vision and facial rashes, joint pain, flu type aches etc when going out. The DWP just dismissed it when assessing my ability to undertake a journey. I had a motability car (now gone) with heavily tinted windows and a solar reflecting windscreen, sun blinds etc. I wear polarised sunglasses whenever I go out and slap on SPF50 sunscreen. The DWP response was to say the DWP cannot be expected to control the weather. These people are so ignorant it beggars belief. The DWP told me (in their refusal after my MR request) that the first mobility activity about planning and following a journey is to assess people with severe mental processing problems such as autism, where the claimant does not understand where they are or how to get somewhere. They said mobility activity 2 covers physical problems, but it is clear that those descriptors are purely based on a persons ability to move and (in my experience) only people who are restricted to using a wheelchair 100% of the time seem to get the high rate on this activity alone. I have fibromyalgia and mainly use crutches, but if my chronic pain and fatigue is really bad I use a wheelchair. Still only scored 4 points for mobility! I am appealing. Lost my DLA last October, really struggling financially and missing my car as I cannot afford to replace it and my village lost it's bus service in cutbacks last summer. Have been waiting four months for tribunal date.
It is VERY hard to score points under mobility activity one.

@Misty6...Thanks for your reply but sad news, how long did they give you to give car back? I assume we will be in similar situation soon, I need to plan..

I don't know if I'm considered average but I had 6 weeks notice of having to give my motability car back from the time I received my decision letter.

Naturally, I didn't want to part with my beloved car and didn't take it back until the very last day I could lol When I took it back, the chap said it's crazy how many people are losing their car's under this PIP when it's obvious most of the people who have to give their cars back REALLY need them. Shame he's not one of the decision makers eh :unsure:

Now awaiting an appeal after having no change made for my Mandatory Reconsideration business. Not looking forward to this but, I feel it has to be done.

Its right circus :( so what happens if you win your appeal do you get the car back ?? MR never changes a decision its joke, its so stressful and costly this business and it must be costing the taxpayer a fortune in Admin costs any savings they make goes on Admin and people getting more sick as result.

You won't get the same car back, Motability sell these off as soon as they are returned, but you can place a new order. Check their website for more details.
