Hi there, So I finally received my PIP decision and i've dropped from Higher, Higher to Standard, Enhanced. Although I am relieved beyond words to keep my motability car :woohoo: the daily living component only scored 9 points :(
I've followed the template on the MRN guide for writing my submission and just wanted to check something. Obviously any appeal or MRN comes with the warning (Threat) that all will be looked at again and possibly lost......I don't like threats so I am going ahead.
I use aids and adaptations but I also require physical help with tasks. Do I say I believe descriptors c and e best describe me or just go for the assistance one?
I have also pointed out the ones I do agree with and added in the descriptors and explanation. Is that ok or too much? my submission now covers four pages....... :unsure:

You should confirm any Descriptor that you think that you meet, if you just go with the assistance ones and the DM disagrees with you then you have no fall back position.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi G, Thank you for those notes. I have a copy of the assessment report, I did tell the assessor that I need help with these things but it hasn't been entered. It does seem that the DM has referred to this report in preference to my original application and not in conjunction with it (not unique I am sure) below is an example of what I have written in my MRN, I've ensured I've covered what I wrote in my application alongside what the F2F assessor said. Do you think it's ok?


Washing and Bathing:
I do use aids in my wet room, as stated I have a shower seat and grab rails and the floor is on one level. I am unable to bend to wash my lower legs and feet myself and therefore my husband or daughter washes these for me whilst in the shower. I am unable to twist my spine (due to the fusion) and so they wash my back too. If I feel strong enough to have a bath then my husband or daughter needs to assist me with washing my lower half and, usually my husband, physically helps me into and out of the bath/shower. I would never be able to shower or bath without another person being present due to the risk of falls.
I believe descriptors D and E best suit my abilities.

Hi Billie,

Have you already explained exactly why you cannot perform the activity without help and what happens if you try? If you have not already done so, you should include this information now.

Don't forget that you can only score points once for each descriptor.

Hi there, Thank you for those points, is it appropriate for me to send you my entire submission for you to critique, I really want to make sure I get it right (obviously). From what I have read, the DM should choose the descriptor with the highest score.....
