Hello, I have finally been given my appeal date for April 3rd my original hearing was on 31st October 2016, the hearing was postponed as apparently I had too much additional information and they also wanted to have access to my doctors note dated back to January 2016.
The doctors notes were sent and received by December 10th 2016 as requested.

I returned to employment December 19th 2016 as my personal life was less chaotic as my son was admitted to hospital and will remain there for at least the next 6 month receiving treatment.

One of the reasons I was unable to work was the impact that my sons chaotic lifestyle had on me, I was constantly on edge and worried ,not sleeping etc etc.

The advice I am looking for is... would the appeal be able to take place in my absence if I requested? I feel that as the tribunal judge and others have had nearly 4 months to read all there is about me and as stated they only want to know how I felt between the time of my claim which was January 2016-May 2016.

You can opt for a Paper assessment if you want, but just so you are aware, the panel and it may be a new one, will not have spent the last four months reading your file, they don't review the claimants documents until the day before or even the day of the hearing, depending on how many cases they have in their diary.

If you still want a paper hearing then contact the Clerk of the Court at the venue where the original hearing was held.

Oral hearings, where you appear in person, are around 4 x more likely to succeed than paper hearings.
