PIP Appeal for my son who is profoundly deaf

My son is now 22 and has worn a cochlear implant since he was 5, he has been turned down for PIP as he only received 6 points for daily activities.
He had been awarded DLA for life, but we all know that was a lie..

Anyone in the same boat?
Any advice will be graciously accepted.
I have arranged to see a solicitor tomorrow for some legal advice.
Just trying to gather up as much info as i can.
I only have two weeks left to get my appeal letter in.

I'm sorry that you and your son are going through this :(

You say you have to submit an appeal request. Do you actually mean appeal, or are you talking about a Mandatory Reconsideration? The MR is an essential step before an appeal can be accepted.

Have you got a copy of the assessor's report? This can help you understand why points were not awarded against the descriptors. DWP usually send them out on request. However, if you need to request an MR, please make sure DWP receive this in time, even if the report has not arrived. You can tell DWP that you will send in more information when you have seen the report and they should allow you more time.

What are you hoping to achieve by seeing a solicitor? Few of them are expert in welfare law and you could well be wasting your time and money :(

Did you use our PIP guides to help you fill in the PIP forms? Even if you did, I suggest you have a good look at them now, they explain the MR process and the criteria against which claimants are assessed (these are very different from the DLA criteria).

May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your son's PIP without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too :)

Hi Bryan

I have submitted a medical reconsideration for my 24 year old profoundly deaf daughter, who was implanted at the age of 5. We are still waiting for the outcome, although I do not expect them to change the decision and fully expect to go to tribunal. My daughter got 4 points instead of 8 for communication, which I am appealing . I am also appealing 0 points for engaging socially and following journeys.

I found the NDCS PIP guide really helpful.

I hope that you achieve a good outcome for your son.
