Hi

If you were put in the work programme during a WRAG period, and then moved onto Support Group, do you still have to remain in the WP?

And also, do you have to attend meetings with advisors still?

My advisor seems to think nothing has changed.

Hi mao,

Even though once you are placed into the Works Programme you remain in it for 2 years maximum, once you are a member of The Support Group, you do not have to comply with any WFI's or WRA.

Although you can volunteer, you cannot be mandated to do so.

Quote the following to your Works Coach/Adviser/WPP if they still insist that you do :


ESA Reg 54. (1) @ (2) (b)

"not a member of the support group"

Which is reiterated by :

(Advice to DM's) DMG Chapter 53 53014. 2.

53014 The conditions referred to in DMG 53013 are that the claimant is :

1. entitled to ESA or an advance award of ESA2 has been made (DMG 53200 et seq)

and

#2. not a member of the support group#

and

3. under the age at which a woman of the same age as the claimant attains pensionable age (see DMG Chapter 75)

and

4. not a person who is only entitled to ESA(Cont) payable at nil rate

5. not a lone parent who is responsible for and a member of the same household
as a child aged under one.

Which clarifies that "members of The SG" CANNOT be compelled to take part in WRA, including WFI's.
