Hi

I've just received my PIP decision and have lost the higher rate for mobility. The effect of this is that I will not be able to attend consultations at The Royal London Hospital neither will I be able to attend Clacton Hospital for my treatment.

Can I challenge part of the decision?

I am sorry you did not get the PIP result you believe you should have :(

The first thing to say is that PIP was deliberately made more difficult to get than DLA. This was done with the express intention of cutting the benefits bill :angry:

I suggest you read through our PIP guide so that you fully understand the criteria against which you were measured. It may be (as I don't know anything about you or your limitations) that you actually don't meet the criteria for the enhanced award.

If you do decide to challenge this, you can certainly ask for just the mobility element to be reconsidered. However, both DWP and the tribunal service (if this gets as far as appeal) have the right to look at both elements again. The Mandatory Reconsideration can reduce the award, although this would be open to appeal.

Do you have a copy of the assessor's report? DWP usually send these out on request and it can help explain why you did not sore points where you expected.

If you wish to take this further, your next step would be to request a Mandatory Reconsideration (this process is explained in the PIP guides). You have one month from the date of the decision letter in which to submit this and have DWP accept it without question. You don't have to give a lot of information at first. If your copy of the assessor's report has not arrived, just tell DWP that you will send in more information when you have seen it and they should give you more time.
