DLA to PIP

DLA to PIP was created by mintdrop
Was awarded for care and mobility components at tribunal hearing 3 years ago. Both for indefinite period

Should i send a copy of it to PIP or is it not relevant to them.

You can't do any harm by sending it, but the criteria for DLA is very different from that for PIP so I would not expect too much from it.

Had my PIP assessment on 1st March got letter today pip been refused, The assessor did not ask me one question about any of my health issues, I am profoundly Deaf in both ears, use 2 hearing aids. My assessment took place in a small room, it was very quite and i was sat 3 to 4 foot away from the assessor, she looked at my face when talking to me and spoke clearly, so i was able to understand what she said to me, because of this PIP say i have no problems hearing people talk to me. I live in a very silent lonely world. I am going to appeal, i would be very grateful for some help writing my appeal letter

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi Gordon,

I have my mandatory reconsideration notice, it is dated 17th March 2017, but only received it on 29th March 2017. I take it that i have a month from the date of the letter to reply ?

In the letter it indicates how many points i have and a letter of the decision maker.

Sorry not understanding things very well here feeling very distressed, so do i need to get copy of the report that the assessor made ?

I just need to confirm.

The letter you mention, is that a Decision Letter or have you already requested a Mandatory Reconsideration and received a Decision on the MR?

If you do have an MR Notice then the next stage is to appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
