The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thank you, I have asked for the assessors report but have yet to ask for a mandatory reconsideration. I telephoned them on Thursday and I felt like the lady was trying to get me to do it there and then. She said I would be called back within three hours to discuss the reason for the MR but without the paperwork I am working blind, so to speak.
To be honest I didn't expect the decision to come through so quickly. I had to return the PIP form by the 9/3/17, then the F2F and a decision by 5/04/17.
I am going to draft a letter later but am unsure if I have to give my reasoning why I want the MR at this stage or do I send that later?

If you have received the assessor's report then you can give all information when you request the MR. If you are still awaiting the report, you can give minimal information and tell DWP that you will send more when you have seen it. Be warned that DWP are prone to 'jump the gun' and carry out the MR before the claimant has had chance to send in the extra information.

I will write today and then send in the reasons why when I get the report.
Thanks again for taking the trouble to respond , I would be totally lost without you as I have never been in this position before.
