Hi I am a bit confused
My wife received her letter today informing her pip yearly update
The rates of pip are looked at every year and any changes will yoke place from 10th April 2017
What this means for you
Your current total weekly amount is £76.90 wrong she's on high rate motability for life current total is £58.00 .your new total weekly amount is £77.65 from 10th April 2017
How this is made up new daily living amount is £55.65
The new motability amount is £22.00 I know that she doesn't qualify for a car now
Some say appeal but she's getting more money than before thinking about buying a car based on monthly allowance . Question is there is no date letting her know how long this is for and as she's now on standard motability will she still qualify for blue badge . When will she have to hand car back

Hi H1316,

It looks like your wife has recently gone through the DLA to PIP reassessment and has been awarded PIP Standard Daily Living (SDL) & PIP Standard Mobility (SM)

Most benefits are uprated in April each year (where applicable) and the uprating for benefit year 2017/18 starts from 10/04/17 and those rates will be in force until April 2018.

The 2017/18 rates for SDL = £55.65/Week and for SM = £22.00/Week = Total PIP Weekly payment of £77.65 for year 2017/18.

Th length of her PIP awards should have been on the PIP Decision Notice letter that she should have received to initially inform her of the PIP decision.

Typically, PIP awards last for 1, 2, 3, 5 or 10 years. The best PIP award is "for an ongoing period" which is the nearest equivalent to the old DLA indefinite awards and should mean no review until at least 10 years have passed.

You state that you do not wish to ask for a Mandatory Reconsideration (MR)/appeal of the PIP decision, if you did you have one month from the date of the PIP Decision Notice letter to do so, although late MR's/Appeals can be requested up to 13 months after the date of the PIP decision notice letter if you can show good cause.

"What are the timescales for taking the car back?

The DWP will continue to pay your existing level of DLA for four weeks after their decision that you do not qualify for the Enhanced Rate of the Mobility Component of PIP. Once we have been informed of the DWP’s decision, we will write to you with details of how to return your vehicle. You will be able to keep the car for a maximum of 21 days after the DLA payments stop.

It is very important that the car is returned within 21 days of the DLA payments stopping or you will not qualify for the one-off transitional support package."

Thanks for your reply bro58, phoned dwp and was informed that no decision had been made yet well none that they could see , but then they told me that payments for car would stop on 11th April , then was phoned by a case manager who told me that as you said standard rate daily living which my wife never had and standard rate motability she was on high rate for life also award is only for 2 years . Recieved letter from motability informing my wife about car being returned and my wife still hasn't received award letter from pip . She's so stressed out that we have went out and bought a car so she can still get about . She won't be caught out again I have told her to keep a diary and any time she's in pain go to the doctor instead of lying in house suffering in pain .

If you have not been awarded PIP or the award is not what you expected then you need to look at the next steps and whether you want to pursue them or not.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
