Hello, I'm in the process of completing my ESA reassessment form with the help of your invaluable resources- thank you very much. I have various medical conditions ranging from spinal stenosis to hip dysplasia and impingement in both shoulders, one of which has resulted in a rotator cuff tear. Now, although extremely painful and difficult, I could still attend a face to face assessment. However, I care for my daughter with severe autism, who cannot be left unsupervised and won't accept anyone other than myself looking after her. It is because of this that I would be unable to attend a medical assessment and don't know how I can go about insisting that a home visit takes place. I have tried my local MP and she wasn't of much help unfortunately. My GP has written a letter for me to include with the ESA forms, but I'm not sure if that's enough to guarantee it. I absolutely cannot leave my daughter otherwise she would be at great risk of harm. This also means I cannot be placed in the work-related activity group because I would not be able to attend the activity sessions due to my daughter developmental disorder. Could you please help me? Thank you.

I think you will struggle to get a home assessment, they usually only allow these on medical grounds, all I can suggest is that you emphasise the need to bring your daughter to the assessment with you and how much disruption she will create but you do need to be aware that this may also be classed as failing to participate.

I'm sorry to have to say this, but your caring responsibilities will not be considered in regard to which group you will be placed in if you are awarded ESA!

Thank you for getting back to me so quickly. Do you know if it's possible to be placed in the work related group and not have to attend the activity sessions i.e. could it be done over the phone instead?

There is nothing to excuse you from attending Work Focused Interviews if your are in the WRAG although you JC+ advisor may be willing to defer any requirement or to hold it over the phone, but if they do not make any allowance then you need to be aware that failing to attend can lead to your benefit being sanctioned.

The same applies to Work Related Activity unless you meet one or more of the following;

- you are a lone parent who is responsible for and a member of the same household as a child under the age of 5;
- you are entitled to a carer’s allowance; and
- you are entitled to a carer premium under paragraph 8 of Schedule 4 to the ESA Regulations.
