Hello everyone, long time member of the site, just resubscribed and have an initial query

I am a carer to my partner, they were intiially on DLA and then reassesed for PIP which was awarded, 2015, ending in 2020,

I have an original income support application and from memory ( I do have the info but will find it out) I think he was moved onto ESA around 2013.

We have recently been sent an Capability for Work Questionaire which has to be filled in by end of April 2017.

Is this normal?

I say this because I have had to fight, sometimes at appeal for pretty much everything that has ever been awarded to him, it just seems we have to keep jumping through hoops to maintain a benefit award and on a very often basis.

I have read regarding the new changes on some of the benefits due to I think the Govt losing out in a court of appeal ruling and in doing so they have reset the playing field to suit

My partner has a number of illnsesses, ranging from poor mobility due to a back injury/operation/incontinence, personality disorder inclusive of paranoia (well documented) I am his carer and now I'm struggling due to what I think they call carers strain, it's difficult for me to get him around some of the time...

So, is this 'questionaire' normal procedure or have we again been selected for hoop jumping?

I don't expect things to be left alone from award to award but i really do feel like I am constantly having to answer these bloomin forms.

Although ESA is an indefinite award all claims should expect to be reassessed at any time after three months have elapsed from the date of the previous Decision up to a maximum of two years for the WRAG and three years for the Support Group.

This is a full reassessment of your partner's claim and he/you need to complete this new ESA50 in detail (as a new claim) and provide any evidence that you have available even if you have submitted it before.

Please use the latest ESA Claim guides as there have been updates to the ESA Descriptors, Regulations and Guidance in the last four years.

Hello,

Partner assessed mid 2015 for PIP, high rate on both until 2020, converted over to ESA i think around the same time or a little before.

Out of the blue last week he received a an ESA50 Questionaire, is this normal? I read somewhere that the Questionaire is only sent to those the DWP consider as possibly not qualifying to be in the Support group?

I probably could do with some help/guidance ? on filling it out as some of thee questions are a bit vague with the 'it varies' answer, which of course things do but to answer it as 'it varies' seems a bit...well, vague and open to intepretation by the DWP in a negative manner.

Should I refer to the original PIP form and the answers given there? Nothing much has changed on my partners combined physical and mental disabilities save for a progression of some of the physical disabilities and an increase on the amount of medication he takes.

One of my main concerns is, a face 2 face would need to be conducted if it has to be at home, I am concerned muchly of the impact this visit will have on my partner, he is (not can) somewhat aggressive when challenged by authority and he is off the radar since this form has come in and where I've had to tell him a visit may be coming...what are the viable alternatives?

Apologies if this sounds like a complaint/rant, it isn't meant to be but I really am quite worried/apprehennsive as to what may possibly lay ahead, I thought with all the form filling previous we'd be left along for a time

Finally and in any scenario is it best also to get a covering letter from his gp regarding a f2f and let them set the tone? (that is assuming our GP offers this services, I am unsure)

Hi Deb,

I have merged your query with the previous one you posted regarding your partner's situation. I have done this for two reasons - first and foremost because we ask members to keep everything relating to the same claim in one topic. Secondly because Gordon has already answered part of your question.

I am a little confused because you talk about an ESA50 questionnaire and then mention referring to the original PIP form. I hope this was simply and error on your part as the two benefits are completely different, with different qualifying criteria.

As far as the face2face assessment is concerned, I must warn you that a home visit is highly unlikely for claimants who have any history of aggression/anger issues. This is to protect the health and safety of the assessor. Your best bet of getting a decision without a face2face is to follow the guide closely and supply as much relevant information/evidence as you can. There is a link to the ESA guide in Gordon's reply to your first message.


May I suggest that you bookmark/favourite this on your web browser now so that you can find it easily in future? This will allow you to return with further questions or comments about your partner's ESA without having to start a new topic each time. We ask members to keep everything relating to the same claim in one topic as it helps us enormously - and I hope you will find it useful too :)

Apologies for the doubling up, I didn't think my first message had gotten through or hadn't made it through the pre-mod stage as I couldn't see it on the board. It wasn't my intention to duplicate.


I drew the similarity of pip/esa as some of the questions in the ESA50 reminded me of similar ones in the pip form, so the same answers would apply (but until this afternoon I was unable to find all of the previous paperwork from previous forms sent etc.

I do have a few questions but the 2pm/4pm session is difficult to get to without being disturbed so will try the later sessions.

I have taken the online test a couple of times, points scored put my partner in the support group...but also into the other group which i read the explanation why but was still confused (not difficult in my case)

Also the sensory impairment questions confuse me, my partner sensory issues re spatial but I can't quite answer the ESA50 question as it's a bit vague (to me) are spatioal issues similar to him not tolerating anyone (even me at times) in/around him .

Sorry if this sounds muddled, I will bring myself up to speed soon, the ESA50 has thrown me and I have enough to be going on with just now and this form by itself has thrown him into a loop and I'm the one left trying to appease and...well I'm failing.

I can't actually find a previous ESA, i have it in my mind that a long time ago inbetween the original IB claim and the DLA to Pip that he was sent something but refused point blank to allow me to fill it in, he said they were spying on him...so I sent it off explaining the reasons for it not being filled in and I think that is when they placed him into the support group.

Be cautious of using answers from a PIP form on this ESA one, the criteria, even where the activities are similar, are actually different and you could easily give an incorrect view of your partners problems by doing this.

You refer to a sensory impairment question, do you mean question 7 - Communicating – hearing and reading?
